The SelectPlan for Women family includes the woman applying for or receiving SelectPlan benefits, and only the husband, children and stepchildren of that woman who live in the household. Pa Family Planning Waiver of 12/29/05
Parents and siblings of the SelectPlan woman as well as non-immediate family members and unrelated persons residing in the household are not included in the SelectPlan for Women budget group.
The CAO or CU must include the following family members and the member’s income:
SelectPlan applicant.
Husband of the SelectPlan applicant, including common-law.
The child (natural, adoptive or step) of the SelectPlan applicant, if the child is living in the household, under the age of 18 and is unemancipated.
NOTE: Per Act 144 of 2004, Pennsylvania will no longer recognize a common-law marriage entered into after January 1, 2005.If an applicant states that she has a common-law spouse, the CAO must obtain proof that the couple presented themselves to the community as a married couple before January 1, 2005. The CAO must obtain proof, which includes, but is not limited to, the deed to their residence,income tax records, bank records, leases, utility bills, or statement from knowledgeable individuals.
NOTE: In the case of recipients whose record indicates that they have been presenting themselves to be married under common-law prior to January 1, 2005, the CAO should continue to recognize the common -law marriage.
The CAO or CU may include the following family members and the member’s income, if it will benefit the SelectPlan individual:
The child (natural, adoptive or step) of the SelectPlan applicant, if the child is living in the household, age 18 or older, financially dependent and under the care and control of the applicant; this includes a disabled adult child.
The CAO or CU will not include the following family members:
Any family member who receives TANF cash assistance, a state-funded cash benefit or Federal Supplemental Security Income (SSI) benefit;
The child (natural, adoptive or step) of the SelectPlan woman who is:
Age 18 or older and not financially dependent upon the applicant.
Under age 18, emancipated and not financially dependent on the applicant.
Married.
NOTE: An emancipated qualified child is under the age of 19, and not under the care and control of a parent or is married.
