The state where the individual is physically located is that individual’s state of residence. When a person from another state is admitted to an LTC facility in Pennsylvania, the CAO where the LTC service is being received must treat that individual as a Pennsylvania resident and decide whether the individual is eligible for MA LTC benefits. 55 Pa. Example: Mrs. R., who lives in West Virginia, is visiting her son in Dauphin County. She suffers a stroke and is admitted to an LTC facility in Harrisburg. The Dauphin CAO authorizes MA LTC payments if it finds that she is financially, nonfinancially, and functionally eligible.
The CAO must not deny MA to an eligible individual who entered an LTC facility before becoming a resident of Pennsylvania.
Example: Mrs. D. lives in Ohio. She chooses an LTC facility in Pennsylvania to be near her daughter so that her daughter can visit her. Mrs. D. meets the residency requirements when she is admitted to the LTC facility.
