Section 303(a) of the Medicare Catastrophic Coverage Act says that a resident in an LTC facility may make income available, within specific state limits, for the support and maintenance of a community spouse (CS), dependent child, or disabled child remaining at home. This income, when combined with the income of the dependent child, disabled child, or spouse at home, cannot be over the monthly amount set by the CAO. 55 Pa. Code § 181.452 (d)
The Institutionalized Spouse (IS) may chose to make less money available to the CS or child. The individual or representative must complete a Transfer of Income to Community Spouse/ Child Form (PA1847) If the signed form is not returned to the CAO within 10 days, the IS’s payment toward cost of care will change.
