For GA-related categories of MA, the CAO must deem resources available from a spouse, including a common-law spouse, who is living with the client and who is not getting TANF, GA, SBP, SSI, or MA. 55 Pa. Code § 178.151
The CAO must add the resources of the LRR to the resources of the applicant/recipient group and compare the total with the resource limit for the number of persons in the applicant/recipient group. The LRR must not be included when figuring the resource limit.
The CAO must figure the countable resources of the LRR using the GA-related rules in Chapter 340, Resources. The client must show proof of the LRR's resources.
The deeming of resources ends on the first day of the month following the month in which the LRR no longer lives in the household.
NOTE: Although the deeming of resources stops, the client must, the best he or she can, confirm the resources of the LRR who is out of the household.
