581.2 Method of Discovery

The CAO must restore benefits that a household is entitled to, regardless of the method of discovery, when:

• The household makes a written or oral request;

• The CAO discovers a loss of benefits;   

7 CFR § 273.17(b)

NOTE:  When the CAO discovers the loss, it must automatically restore benefits without requiring the household to request restored benefits.

• A fair hearing decision is favorable to the household; or  

7 CFR § 273.15(s)(1)

• The household disputes in court a disqualification for intentional program violation and the court reverses the disqualification.
