All property that comprises the decedent’s probate estate is subject to DHS’s claim. Estate property is defined as all of a decedent’s real and personal property which is subject to administration. It includes, but is not limited to:
Life insurance which is payable to the decedent's estate.
Trust assets and burial reserve proceeds payable to the decedent's estate.
Assets designated for a testamentary trust.
