An overpayment may result when an individual does not report a change in a timely way. The Office of State Inspector General (OSIG) will evaluate the reason for the failure to report when deciding whether to prosecute or seek restitution.
The OSIG collects an overpayment without prosecuting the individual if the individual does not report because of:
misunderstanding of eligibility requirements;
misunderstanding of reporting responsibility;
innocent concealment of facts; or
CAO omission.
An individual who willfully withholds information or willfully does not report changes is subject to prosecution. See Supplemental Handbook, Chapter 910, Overpayment Recovery.
