If the company and the union disagree about whether a work stoppage is a strike or a lockout, the CAO will provide its area manager with the following information:
The name and address of the company
The names and telephone numbers of company and union representatives
The date the work stoppage began
Demographic information about an applicant
The area manager will forward this information to the Bureau of Policy.
The Bureau of Policy will:
Contact the company and union representatives for their statements, and
Contact the PA Department of Labor and Industry to ask whether it has issued an official determination and if unemployment compensation benefits are authorized.
NOTE: The PA Department of Labor and Industry’s Office of Unemployment Compensation Programs decides whether the situation is a strike or a lockout. DHS must accept this decision.
If a determination is not made at the state level, FNS will determine whether the situation is a strike or a lockout.
The area manager will notify the CAO of the decision so an appropriate eligibility decision can be made.
