880.3 Provider Responsibilities

All agencies taking part in DHS programs must agree to care for and serve DHS clients without discrimination. The nondiscrimination policy applies to all medical institutions, home nursing care agencies, providers, and vendors. The policy applies to admission, application, and participation requirements as well as to all types of treatment provided. Agencies, providers, or vendors who do not follow the rules of the nondiscrimination policy will not be paid.

55 Pa. Code §107.3(d)

Exception: When a person has a medical emergency that requires care to prevent the person’s death or serious harm to their health and the care can be given only by a provider that has not complied with the nondiscrimination policy, the DHS must pay for the services.

The provider must certify on each invoice submitted for payment of services provided to DHS recipients that it is in compliance with the nondiscrimination policy.
